The political landscape in Bihar is undergoing significant changes as the new government, under the leadership of Nitish Kumar, seeks a vote of confidence on February 12. However, before that, the ruling party needs to pass a no-confidence motion to remove the Speaker of the Legislative Assembly. The Rashtriya Janata Dal (RJD) has now posed a challenge to the ruling party, with RJD MP Manoj Jha stating that Nitish Kumar should remove the Speaker before facing a floor test. To remove the Speaker, they would need the support of at least 122 members, emphasizing the precedent set by Supreme Court decisions in states like Arunachal Pradesh and Maharashtra.
According to Manoj Jha, based on these decisions, Bihar would require a minimum of 122 members to remove the Legislative Assembly Speaker. In a sudden move, leaders of the Mahagathbandhan alliance, including Tejashwi Yadav, joined Manoj Jha outside Tejashwi’s residence in the afternoon. Jha stated that the entire process of removing the Speaker on the 12th should be within the purview of Supreme Court decisions for the sake of justice. During the press conference, Jha referred to Article 179 of the Indian Constitution, outlining the procedure for removing the Legislative Assembly Speaker.
Senator Manoj Jha, in a symbolic gesture at Tejashwi Yadav’s residence, offered different interpretations of “Gandhi” based on currency depictions – whether it be the Gandhi on currency notes or the “Hey Ram” Gandhi. He questioned Gandhi followers, asking which version they preferred. If respect for the currency Gandhi is paramount, then decisions should align with past practices. However, if it’s the “Hey Ram” version, then considerations should be made in the light of Supreme Court judgments.
