In a recent development, the Bihar Government has decided to retract its petition before the Supreme Court concerning the involvement of B.Ed degree holders in the recruitment process for primary teachers this year.
The state had initially filed this petition challenging the Patna High Court’s decision, which rejected its plea for interim directions and clarifications related to these appointments, given that the written examination has already concluded, and the results are in progress.
The state government contends that the recruitment process for primary teachers is nearing completion, and excluding B.Ed qualified candidates at this advanced stage would introduce complications.
The Supreme Court’s previous order, which invalidated the 2018 NCTE notification allowing B.Ed degree holders to qualify for primary school teacher appointments, came after the entire examination process had concluded, as stated by the state in its plea.
During the court proceedings, the counsel representing the Bihar government suggested that instead of conducting a re-examination, the government could release the results. However, advocate Prashant Bhushan indicated that they had filed an intervention petition in the case.
“There’s also a petition which is coming on Thursday where they have said that it can be allowed at least this time,” Bhushan stated.
Following deliberation from both sides, the Court determined that the matter should be referred to Justice Aniruddha Bose’s bench. Subsequently, the representative for the Bihar government, Nadkarni, withdrew the case.
