TRE 2023: Bihar govt warns new teachers of strict action if they form association

In a firm directive, the Bihar government has cautioned recently appointed teachers against forming any associations and participating in protests against the policies of the Education department. The stern warning, issued by the Education Department on November 11, comes as around 1.20 lakh teachers, who successfully cleared the Bihar Public Service Commission (BPSC) recruitment exam in 2023, received provisional appointment letters on November 2.

Despite not having been assigned postings or commencing teaching duties, the Education Department noted the formation of an association among some appointees who are critical of the department’s policies. This has been deemed a serious violation of the Bihar Government Employees Conduct Rules-1976.

The department’s statement emphasized that the selected teachers from BPSC should refrain from forming any unions or participating in them. Violation of this directive, as per Section 17 of the Code of Conduct of Bihar School Teachers Rules 2023, could lead to strict disciplinary action, including the immediate cancellation of provisional appointments.

The statement highlighted the illegality of the formed association, which has even printed its letterheads. The department has sought an explanation from an office-bearer of this association, who is a newly recruited teacher. It warned that the provisional appointment of teachers involved in such activities could be canceled without delay.

Despite attempts to obtain comments from Bihar Education Minister Chandrashekhar, he was not available.

Reacting to the Education Department’s statement, Raju Singh, convener of TET Primary Teachers’ Association, expressed support, stating that the decision aligns with the law and government employee conduct rules. Singh emphasized that individuals can express their views within the legal framework after completing their probation period.

Approximately 1.20 lakh candidates successfully cleared the BPSC examination for 1.70 lakh teacher posts in the state. The distribution of appointment letters took place in Patna Gandhi Maidan and every district of the state.
