In a noteworthy legal development, Advocate Shama Sinha has filed a Public Interest Litigation (PIL) at the Patna High Court, bringing forth a critical concern regarding the non-utilization and mismanagement of funds collected under the Health and Education Cess since 2008. Formerly recognized as the Secondary and Higher Education Cess, these funds are earmarked for the explicit purpose of advancing education and health initiatives throughout India.

The petitioner contends that the failure to judiciously employ these funds has significantly and adversely impacted the education sector, with the State of Bihar serving as a prominent example. The crux of the argument lies in the fundamental principle that a cess is a specific levy collected for a precise purpose, in this case, the enhancement of education and health initiatives. However, the plea underscores serious shortcomings in directing these funds toward their intended objectives.

Particularly, the Madhyamik and Uchchtar Shiksha Kosh (MUSK), a mechanism designed to leverage these funds for educational schemes, has yet to be operationalized as per the findings of the Comptroller and Auditor General (CAG) report, as stated in the petition. The petitioner draws attention to various reports by the CAG of India, parliamentary standing committees, and recent budget allocations, all pointing to issues such as underutilization, misallocation, and delays in deploying these cess funds.

Moreover, the plea accentuates the apparent lack of transparency, accountability, and compliance with CAG recommendations in the management of these funds. In response to these pressing concerns, the petitioner seeks the Court’s intervention to issue directives ensuring the immediate and proper utilization of the accumulated funds. The plea additionally calls for the operationalization of MUSK in alignment with statutory obligations, the establishment of a transparent mechanism for fund management, and strict adherence to CAG recommendations.

This PIL is not merely a legal pursuit but an earnest endeavor to invoke the Court’s authority in enforcing the principles of fiscal accountability, transparency, and good governance in handling these critical funds. As the case unfolds, it holds the potential to bring about corrective measures and heightened accountability in the utilization of Health and Education Cess funds.
