Strengthening India’s democratic institutions: The case for consensus-based appointments

In a democracy, the impartiality and integrity of institutional heads play a pivotal role in upholding the rule of law and ensuring the effective functioning of governance. Therefore, the process of appointing key officials such as Election Commissioners, CBI Chiefs, ED Chiefs, Judges in Supreme Court and High Courts, CVC, and other governmental institutions should be conducted with the utmost transparency and consensus.

Currently, the appointment of such top officials often involves decision-making by a select group, such as the Cabinet Committee on Appointments. However, the absence of a consensus-based approach can lead to partisan interests overshadowing the merit and suitability of candidates. This has the potential to undermine public trust in these institutions and compromise their independence.

To address this issue, it is imperative to adopt a consensus-based approach to appointments, wherein all members of the decision-making body must agree upon the proposed candidates. This ensures that appointments are made with the collective endorsement of the stakeholders, fostering confidence in the integrity and impartiality of the appointees.

Moreover, the consensus-based approach mitigates the risk of political interference in appointments. By requiring unanimous agreement from all members, it prevents any single individual or faction from exerting undue influence over the process. This safeguards the independence of institutions and reinforces their credibility in the eyes of the public.

Implementing such a mechanism would require a shift in the current decision-making paradigm. However, the benefits far outweigh the challenges. Consensus-based appointments promote inclusivity, accountability, and transparency, which are the cornerstones of a healthy democracy.

Countries like Switzerland, where consensus politics is deeply ingrained, have demonstrated the efficacy of this approach in ensuring stability and fostering trust in governmental institutions. In India, too, adopting a consensus-based model for appointments can pave the way for a more robust and resilient democratic framework.

As we strive to strengthen India’s democratic fabric, it is imperative to prioritize the integrity and independence of our institutions. Consensus-based appointments offer a viable path towards achieving this goal, ensuring that the interests of the nation supersede those of any individual or political party.
