India to be added to U.K. safe states list, ruling out asylum rights for illegal migrants from the country

In a significant move, the UK government has introduced plans to augment its list of safe states, with India and Georgia among the nations slated for inclusion. The proposed legislation, laid in the House of Commons on November 8, aims to expedite the repatriation process for Indians entering the country illegally and eliminate the possibility of seeking asylum in the UK.

Home Secretary Suella Braverman emphasized the necessity of halting perilous and unlawful journeys to the UK from inherently safe countries. The expansion of the list is designed to facilitate the swift removal of individuals with no legal basis to stay, reinforcing the message that illegal entry will not be tolerated.

Aligned with Prime Minister Rishi Sunak’s commitment to “stop the boats,” the proposal falls under the Illegal Migration Act 2023. Despite an increase in small boat arrivals from India and Georgia over the past year, the Home Office justified deeming these countries safe, stating that individuals from these nations are not evidently at risk of persecution.

The UK’s safe states list, governed by Section 80AA, is contingent upon the Home Secretary’s satisfaction that there is generally no serious risk of persecution of its nationals, and removal to that country aligns with the UK’s obligations under the Human Rights Convention. The Home Office affirmed a rigorous assessment of India and Georgia, ensuring compliance with these criteria.

The draft legislation is subject to parliamentary scrutiny through debates in both Houses before coming into force. It is part of a broader strategy outlined in the Illegal Migration Act 2023, which seeks to prevent illegal arrivals and streamline the return process to safe third countries or home countries.

The government remains resolute in its determination to deter dangerous journeys to the UK, with the Illegal Migration Act playing a pivotal role in breaking the cycle, combating criminal gangs, and preventing further loss of life. Additional measures, including a legal duty to remove, are anticipated in the coming months.
